The Sheriff’s Office provides around-the-clock law enforcement service to every region of the county. In addition to 24 hour policing, we offer Butte County citizens a full range of services including, coroner services, civil services, court security and corrections.

General Process Services

 

Civil Subpoena

 

Service fee is $35 per person or entity. 

We must have 2 (two) copies as one is used as your letter of Instruction.  Please make sure the address for service is listed on the subpoena.

For service of a Civil Subpoena on a Deputy, an additional deposit of $150.00 is required which MAY be refunded if officer is excused from appearing.

Once service is complete, whether successful or unsuccessful, we will generate a Proof of Service and mail to the address on the Letter of Instruction. 

 

 

Order to Show Cause

 

The service fee is $35.00 per person.

IMPORTANT NOTE: The Order to Show Cause MUST be served at least 16 COURT days prior to the Hearing Date unless shortened by the Court.  Please allow additional time if you are mailing service AND for attempts of service to be completed.

Once service is complete, whether successful or unsuccessful, we will generate a Proof of Service and mail to the address on the Letter of Instruction.  Because there is a court date to appear, the Original Proof of Service will be mailed directly to the court for you. 

 

Plaintiff’s Claim & Order to Defendant to go to Small Claims Court

 

Service fee is $35 per person or entity. 

We must have 2 (two) copies of documents for each party as this service may be sub-served to another adult at the address you provide on the first attempt.

Documents must be served at least 20 days prior to the Court date.  Please allow additional time if you are mailing service and for attempts of service to be completed.

Once service is complete, whether successful or unsuccessful, we will generate a Proof of Service and mail to the address on the Letter of Instruction.  Because there is a court date to appear, the Original Proof of Service will be mailed directly to the court for you.

The service fee is $35.00 per person or entity. 

If you request sub-service we must have 2 (two) copies of documents..  If just 1 (one) copy is provided we will attempt personal service only.

Once service is complete, whether successful or unsuccessful, we will generate a Proof of Service and mail to the address on the Letter of Instruction.  It is your responsbility to file the court copy.

 

TEMPORARY RESTRAINING ORDERS:

 

Domestic Violence / Civil Harassment / Elder or Dependant Adult Abuse / School Violence / Workplace Violence

There is NO Fee for the Sheriff to serve Temporary Restraining Orders.

The Notice of Court Hearing form (DV-109 / CH-109 / EA-109 / SV-109 / WV-109) will instruct you on which forms must be served.  In some cases you will have additional documents not listed in the instructions.  It is your responsibility to know which forms must be included in the service packet.

 

Please note the Hearing Date and verify adequate time for service of your documents.  Usually, the Notice of Hearing and Temporary Restraining Order must be served at least 5 (five) days before the hearing.  The Sheriff’s Office must have sufficient time for attempts of service. If sending documents by mail, please allow additional time.

 

Once service is complete, whether successful or unsuccessful, we will generate a Proof of Service and mail to the address on the Letter of Instruction.  Because there is a court date to appear, the Original Proof of Service will be mailed directly to the court for you.

Service fee for most all other civil documents is $35.00.
