In addition to 24 hour policing, we offer Butte County citizens a full range of services including, coroner services, civil services, court security and corrections.

Garnishment Process Services

 

Bank Levy Instructions

 

The fee for service on each bank is $35.00

A Letter of Instruction MUST include the name and address for the bank(s), the name and address of each defendant and the Social Security Number, if available.  The Letter MUST be signed by the Attorney or Plaintiff/Creditor, if not represented by an attorney, and include their name, address and phone number.  (Click here for a copy of our form) (PDF)

You must provide the Original WRIT of Execution - Money Judgment (form EJ-130) plus two (2) copies, front and back..

A Proof of Service is not issued.  For a Bank Levy when the Bank returns the Memorandum of Garnishee, it is forwarded to the Attorney/Creditor.

At the end of a Bank Levy Process, we prepare a Return to Court / WRIT of Execution detailing the Sheriff’s actions.  The Original Return and WRIT are sent to the Court who issued the WRIT.  A copy is mailed to the Attorney/Creditor.

 

Earnings Withholding Order Instructions

 

The service fee is $30.00

You must submit a completed Application for Earnings Withholding Order (form WG-001), signed by the Attorney or Plaintiff/Creditor, if not represented by an attorney.

You must provide the Original WRIT of Execution - Money Judgment (form EJ-130)

A Proof of Service is not issued.  For a Wage Garnishment, we send a copy of the Employer’s Return form to the Attorney/Creditor.

At the end of a Wage Garnishment Process, we prepare a Return to Court / WRIT of Execution detailing the Sheriff’s actions.  The Original Return and WRIT are sent to the Court who issued the WRIT.  A copy is mailed to the Attorney/Creditor.

 

EXEMPTION FORMS FOR GARNISHMENTS:

 

Claim of Exemption action may be used by DEBTOR for either a Bank Levy (Enforcement of Judgment) or an Earnings Withholding Order (Wage Garnishment).

 

Bank Levy (Enforcement of Judgment) Claim of Exemption:

 

Defendant has only 15 calendar days from date of service on the bank to submit a Claim of Exemption (Form EJ-160).  We must  have 2 (two) copies filled out COMPLETELY, dated and signed.  You may also submit a Financial Statement  (Form WG-007/EJ-165).

We immediately forward to the Attorney/Creditor your Claim of Exemption documents.  They have 15 DAYS to respond to your request.  If your Claim is accepted, we notify the bank per Attorney/Creditor instructions.  If your Claim is OPPOSED, you are notified by the Attorney/Creditor of a Court date which you should attend.  We take no further action until an Order is received from the Court.

Earnings Withholding Order (Wage Garnishment) Claim of Exemption:

 

Defendant may submit a Claim of Exemption (Form WG-006) at any time during the garnishment of wages as their financial status changes.  A Financial Statement (Form WG-004/EJ-165) MUST accompany your Claim of Exemption.  Please CAREFULLY COMPLETE both forms following ALL instructions.   Be sure to DATE, PRINT NAME and SIGN forms where indicated.

When received by our office, forms are immediately sent to the Attorney/Creditor who must respond within 10 DAYS.  If your Claim is accepted, we notify your employer of the new amount to withhold.  If your Claim is OPPOSED, you will be notified of a Court date which you should attend.  During the entire process, your employer is required to continue the withholding.  There MAY BE a refund of monies we are holding if the amount to garnish is modified.
