In addition to 24 hour policing, we offer Butte County citizens a full range of services including, coroner services, civil services, court security and corrections.

Eviction Process Services

 

General Information for EVICTIONS

Instruction for 3-Day, 30-Day or 60-Day Notice(s)

 

The service fee is $35.00 and you must provide 2 (two) copies of the service documents as we POST and MAIL the notices.

If you serve a 3-Day at the same time as a 30-Day or 60-Day, the fee total is $70 for 2 (two) services and you must provide 2

(two) copies for each document.

A Letter of Instruction including the required 4 items must accompany the documents for service. (Click here for a copy of our form) (PDF)

Once service is complete we will generate a Proof of Service and mail to the address on the Letter of Instruction. Two copies

are provided, one for your file and one for the Court should you need to proceed with service of the Summon & Complaint

Unlawful Detainer.

 

Instructions for Summons & Complaint Unlawful Detainer

 

The service fee is $35.00 PER PERSON and (1) one copy of documents per person is required. If you request service on any

Unnamed Occupants/DOES* in addition to the named tenant, fee is $35.00 and (3) three copies of documents are required,

including the Prejudgment Claim of Right to Possession. (Click here for copy of Claim)

* Note: If serving DOES / UNNAMED OCCUPANTS, service of the Prejudgment Claim of Right to Possession shall be effected by a sheriff, marshal, or

registered process server only.

Once service is complete, whether successful or unsuccessful, we will generate a Proof of Service and mail to the address on

the Letter of Instruction. Two copies are provided, one for your file and one for the Court. It is your responsibility to file the court

copy.

 

Instructions for Evictions

 

The fee for this service is $125.00

You must provide the Original WRIT of Execution (Possession) (Real Property) and 2 copies. (Click here for a copy of

the form)

We must receive the Eviction request prior to 3:00 pm on any Wednesday for the Eviction to be scheduled on the following

Wednesday. If you submit your request after Wednesday at 3:00 pm, the Eviction will be scheduled on the second Wednesday.

The Agent you designate will be notified of the scheduled time for the Eviction on Tuesday prior to the Lockout date. For our

deputy’s safety, please do not discuss the scheduled eviction time with the tenants.

You or your agent MUST be at the location of the Eviction to provide entry and take possession. You may change the locks to

prevent reentry by the defendants/tenants. The Sheriff does not assist in removing personal property. A Restoration Notice

with instructions regarding the handling of tenants’ personal property left in the residence is provided at the time of the Eviction.

Once service is complete a Proof of Service will be mailed to the address on the Letter of Instruction. The Original Proof of

Service and the Original WRIT of Execution will be mailed directly to the court.
