The Butte County Department of Development Services, Code Enforcement Division is responsible for the enforcement of this Ordinance. Our goal is always to achieve voluntary compliance. However, if that is not possible, the Ordinance clearly outlines the enforcement process.

Step 1

Upon receiving a complaint, Code Enforcement (CE) staff will verify that the complaint is valid. 

Step 2

After a file review, CE will perform a site visit of the property, either from public view or via owner granted access. Upon inspection of the garden area, staff will determine if there is a violation.

Step 3

If there is no violation, the case will be closed. The complainant will be notified. If there is a violation, the grower will be given a 72 hour compliance notice. 

Step 4 (a)

If you are in violation, approximately 72 hours later, CE will return and verify compliance with the 72-hr notice. If compliance is achieved, the case will be closed and the complainant will be notified. If compliance is not achieved, an Administration Citation will be issued per Section 34A-16. Fines are as follows: 

  • First Violation: $25-$100 per day 
  • Second Violation: $100-$200 per day
  • Each Additional Violation: Up to $500 per day

Step 4 (b)

If you are in violation, in lieu of or in addition to Administrative Citations/Fines, CE may also commence the Nuisance Abatement process per Section 34A-12&13. This section specifies the time frame and process for abating a violation. It is important for growers to understand that if CE uses this process and the Hearing Officer agrees that the violation(s) was/were present, the property owner will be responsible for ALL costs incurred by the County to obtain compliance.
